A new monograph from SGMK Publishing on the posting of workers in the European Union

The Nicolaus Copernicus Superior School Press in Warsaw has published a monograph titled Issues Related to the Posting of Workers to European Union Countries, authored by Mariusz Miąsko and Anna Nieć-Mrzygłód.

The publication is a comprehensive study on the posting of workers from Poland to European Union countries, combining an analysis of regulations with the authors’ practical experience. It systematically explains key concepts, outlines the development of regulations, and discusses significant changes introduced after 2022 in connection with the entry into force of the Mobility Package, including the distinction between general principles and regulations specific to the road transport sector.

The monograph comprehensively addresses the rules for posting workers from Poland to EU member states, as well as the situation of workers from third countries. The authors provide a detailed analysis of the practical aspects of posting, such as rules for determining remuneration, tax issues, the use of A1 forms and the European Health Insurance Card (EHIC), currency conversion rules, and the methodology for calculating remuneration in individual European Union countries. The study also covers issues related to the employment of third-country nationals.

A key element of the publication is the analysis of interpretive and legislative issues that arise in the practical application of regulations, along with suggestions for possible directions for change. The monograph also provides insight into the legislative process and the influence of practitioners on the shaping of current law.

It is particularly noteworthy that the authors of this publication are co-authors of a significant portion of the legal regulations applicable to the process of posting workers to European Union countries, which gives the study a unique and expert character.
